Fashova AND INTELLECTUAL PROPERTY PROTECTION
Fashova is an e-commerce platform that allows businesses and manufacturers (hereinafter referred to as "sellers") to directly sell their products to end customers. As a passive platform, Fashova does not actively participate in the offering, selling, or delivery of goods by sellers.
As part of its core mission and services provided to users, Fashova has strict rules that prohibit the offering or sale of products that infringe on copyrights, trademarks, or other third-party rights. Fashova provides ways for third parties to report suspected infringements of their intellectual property rights. Fashova also reserves the right to block access to or remove materials that it believes in good faith to be infringing on third-party rights, and to remove sellers or terminate services to sellers who repeatedly infringe on these rights.
Below is some information regarding intellectual property, how authorized parties can report suspected infringements of intellectual property rights to Fashova, and information on how sellers on the Fashova platform can respond when these claims are directed at their listings or accounts. All notifications of suspected infringement of intellectual property rights must be made in good faith and must contain truthful and accurate information. The notifier confirms that they are authorized to act on behalf of the owner of the relevant rights and that they are aware of their responsibility for the accuracy and completeness of the information provided.
Seller Responsibility and Platform Liability Limitations
Each seller is fully responsible for ensuring that the products they offer on the Fashova platform do not infringe on the intellectual property rights of third parties. Sellers are required to ensure that they hold all necessary rights, licenses, and authorizations to offer and sell their products.
As a provider of hosting and marketplace services, Fashova is not liable for the content of third-party listings unless it has demonstrable knowledge of their unlawfulness. Upon receipt of a properly submitted notification of a possible rights infringement, Fashova will take reasonable measures without undue delay, including temporary blocking or removal of the relevant content.
Any claims for damages arising from the actions of a specific seller must be directed against that seller.
Indemnification Obligation
The seller undertakes to compensate Fashova for all damages, costs, sanctions, fines, legal expenses, and other expenses incurred by Fashova in connection with the infringement of third-party intellectual property rights caused by the actions of that seller. This obligation includes, in particular, costs of legal representation, out-of-court settlements, and any damages claimed by third parties, regardless of whether these claims were pursued through judicial or extrajudicial means.
Notice to Trademark Owners
If any trademark owner believes that counterfeit products that infringe on their trademark rights are being sold on the Fashova marketplace, they should immediately contact Fashova to take all necessary legal steps to remove such a seller who violates trademark rights. Fashova takes intellectual property rights very seriously and is committed to ensuring that its platform is free from counterfeit products and other infringing materials. Therefore, Fashova encourages trademark owners to report suspected infringements so that appropriate action can be taken quickly.
Notice and Action Regime
Fashova operates as a provider of hosting and marketplace services within the meaning of the relevant legal regulations of the European Union, including regulations governing the liability of digital service providers. Fashova is not liable for content stored or made accessible by third parties unless it has demonstrable knowledge of its unlawfulness. Upon receipt of a sufficiently substantiated notification of a possible rights infringement, Fashova will take reasonable measures without undue delay, including temporary restriction of access or removal of the affected content. Fashova is entitled to request additional information from the notifier necessary for the assessment of the notification.
Repeat Infringement Policy
Sellers who repeatedly infringe on the intellectual property rights of third parties may be temporarily or permanently excluded from the Fashova platform. Fashova reserves the right to suspend or terminate a seller's account at any time if there is reasonable suspicion of intellectual property rights infringement.
COPYRIGHT INFRINGEMENT
We respect the rights of artists and content owners, and Fashova carefully considers notifications of alleged copyright infringements. If you believe that your copyrighted work is being copied in a way that constitutes copyright infringement and is accessible on Fashova, please notify Fashova's copyright protection representative at the email address copyright@fashova.com.
When submitting a report, please include the following information
- An electronic or physical signature of a person authorized to act on behalf of the copyright owner.
- Identification of the copyrighted work that you claim has been infringed.
- Identification of the material that allegedly infringes your rights and where it is located on Fashova.
- Information sufficient to allow Fashova to contact you, such as your address, telephone number, and email address.
- A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, their agent, or the law.
- A statement that the information provided is accurate and that the notifier is acting in good faith and is authorized to act on behalf of the rights owner.
